  1. You can only sue for malpractice if there was something a medical provider neglected to do that caused permanent physical damage. If you take a case to an attorney, they will request that you bring in your medical records relating to the event and will have those records sent to an expert medical examiner. If that examiner deems that everything was done correctly and the medical provider (doctor or hospital as a whole) did everything in it’s power to ensure a positive result there is no malpractice. With all the advances in medicine, accidents happen and as long as the doctor did everything in their power to try to correct things, generally you will not win the case.
