    Sally will lose the case.

    It would not be good for her case. Because is important–if she got worse Because she forgot to take the medicine that suggests that Dr. Smith had prescribed a medicine that would have helped her if she had taken it, so…her case is probably out the window unless he did something else.

    Was she capable of remembering? If the doctor documented that she had memory troubles then maybe. Lot's of patients forget their medicine when they are capable of remembering, It's called being non-compliant and then it wouldn't be the doctor's fault.

    C'mon now, you know you can't trust Sally.
    The Doctor did his best. If he really screwed up and caused her harm, she chas a good cause of action against him. If he did his best and she still got sicker, hell, Doctors are doctors, not Gods, regardless of what they think.
    If Sally made her condition worse by not taking her meds why blame the doctor?

    Well if this works then I suppose we can also sue Drs. for prescribing medication that is ' too expensive and we can't afford to get the prescription filled and we get sicker. My My MY our courts are really gonna be busy.

    Seriously, Drs. do not make house calls to make sure their patients are taking their morning pills. That's what family and friends are for. I hope she gets better soon.

    If the only reason Sally got sicker was because she forgot to take her medicine than this would be considered contributory negligence and she would be at fault.
