Sounds like just bad luck to me, not malpractice. My son broke his femur in a car accident. He had surgery with an IM nail screws put in. After 6 months, he had no healing. Another surgery, bigger nail screws. This also ended in a non-union. He still wasn't healing properly. The back of the bone had healed abit, but the front was nowhere close. He was finally referred to an Orthopedic Trauma Surgeon.
My son ended up with removal of his hardware, an osteotomy (surgical re-break) a bone graft a new plate screws.
The trauma surgeon couldn't find a reason for his not healing. Everything was done correctly with the first surgeon.
Anywho, my son had 6 surgeries it took 3 years for his leg to heal.

Actually, walking on a broken leg promotes healing

This in no way sounds like a malpractice case to me. I don't believe any of this would hold up in court as there is no proof that the deviated leg was caused by a brace and not the injury. And it is also unlikely that the doctor 'guessed' which brace to put on.

Edit: The fact the doctor told her to walk on it is no malpractice. I would have told her the same thing as that is part of rehabilitation. You can bring it to the court but you will just be wasting your time and money and the time of a doctor that could be helping others.
